“The owner or legally authorized person in control of the vehicle or vessel” means the individual who is considered the legal owner of the vehicle or boat, or someone who has been explicitly given permission by the owner to operate it, essentially signifying the person responsible for the vehicle at any given time, whether they are the registered owner or not.
Key points to remember:
- Ownership:Primarily refers to the person listed as the owner on the vehicle’s title or registration documents.
- Authorized Person:Includes anyone who has been given explicit permission to drive or operate the vehicle by the owner, such as a family member, employee, or designated driver.
- Control of the Vehicle:This phrase emphasizes that the person in question is actively driving or operating the vehicle at the time.
Example situations:
- A car owner driving their own car:In this scenario, the owner is considered the “owner or legally authorized person in control of the vehicle.”
- This example would require the vehicle owner to produce a registration or title to prove ownership of the Vehicle or Vessel that was towed.

- A parent allowing their teenager to drive their car:The teenager is considered the “legally authorized person in control of the vehicle” while driving with the parent’s permission.

- A car owner allowing a friend or other relative to drive their car:The friend or relative is considered the “legally authorized person in control of the vehicle” while driving with the car owner’s permission.
- This example the Authorization form would prove that the friend or relative is considered the legally authorized person in control of the vehicle.
Insurance Cards are NOT proof of ownership and can not be used as such. Only the Title and Registration or a Manufacture of Origin are proof of ownership.
If a vehicle has an open title (just purchased and title is still printed in previous owners name but signed over to new vehicle owner) then the title needs to be taken to the Department of Motor Vehicles and switched into the new owners name prior to picking up the vehicle. If you come to the tow yard with an open title that will be Rejected. The other option in this case is to have the prior owner of the Vehicle be present at time of pickup or produce the Vehicle release form that is located above.
